中共中央國務院關于推進安全生產領域改革發展的意見

  安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)是關系(xi)人民(min)群眾生(sheng)(sheng)命財產(chan)(chan)(chan)(chan)(chan)安(an)全(quan)的大(da)事(shi),是經(jing)濟社會協(xie)調健康(kang)發展(zhan)的標志,是黨和(he)政(zheng)府對人民(min)利益高(gao)度(du)負責的要求(qiu)。黨中央、國務(wu)院歷來高(gao)度(du)重視安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)工作,黨的十(shi)八大(da)以來作出一系(xi)列重大(da)決策部署(shu),推(tui)動全(quan)國安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)工作取(qu)得積(ji)極進展(zhan)。同時也要看到,當前我國正處在工業(ye)化(hua)、城鎮化(hua)持(chi)續推(tui)進過程中,生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)經(jing)營規模不(bu)(bu)斷(duan)擴大(da),傳統和(he)新型生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)經(jing)營方式并存,各類事(shi)故隱患和(he)安(an)全(quan)風險交織疊加,安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)基(ji)礎薄弱、監(jian)管體(ti)制(zhi)機(ji)制(zhi)和(he)法律制(zhi)度(du)不(bu)(bu)完善、企業(ye)主(zhu)體(ti)責任(ren)落實不(bu)(bu)力等問(wen)題依然(ran)突出,生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)安(an)全(quan)事(shi)故易發多發,尤其是重特大(da)安(an)全(quan)事(shi)故頻(pin)發勢頭尚未(wei)得到有(you)效遏(e)制(zhi),一些事(shi)故發生(sheng)(sheng)呈現(xian)(xian)由高(gao)危(wei)行(xing)業(ye)領(ling)(ling)(ling)域(yu)向其他行(xing)業(ye)領(ling)(ling)(ling)域(yu)蔓(man)延趨勢,直接危(wei)及生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)安(an)全(quan)和(he)公共安(an)全(quan)。為(wei)進一步(bu)加強安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)工作,現(xian)(xian)就(jiu)推(tui)進安(an)全(quan)生(sheng)(sheng)產(chan)(chan)(chan)(chan)(chan)領(ling)(ling)(ling)域(yu)改革發展(zhan)提出如下意見。

  一、總體要求

  (一)指導(dao)(dao)思想(xiang)。全面貫徹黨的(de)十(shi)八(ba)(ba)大(da)和(he)(he)(he)十(shi)八(ba)(ba)屆三中(zhong)、四(si)中(zhong)、五中(zhong)、六中(zhong)全會精神(shen),以(yi)鄧小平理(li)(li)論、“三個(ge)代表”重要(yao)思想(xiang)、科學發(fa)展觀為(wei)指導(dao)(dao),深入貫徹習近平總(zong)書記(ji)系列重要(yao)講話精神(shen)和(he)(he)(he)治國理(li)(li)政新(xin)理(li)(li)念(nian)新(xin)思想(xiang)新(xin)戰略,進一步(bu)增強“四(si)個(ge)意識(shi)”,緊緊圍(wei)繞統(tong)籌(chou)推(tui)進“五位一體(ti)(ti)”總(zong)體(ti)(ti)布局和(he)(he)(he)協(xie)調(diao)(diao)推(tui)進“四(si)個(ge)全面”戰略布局,牢固(gu)樹立(li)新(xin)發(fa)展理(li)(li)念(nian),堅持安(an)全發(fa)展,堅守發(fa)展決不能以(yi)犧牲安(an)全為(wei)代價這條不可逾越的(de)紅線,以(yi)防范(fan)遏(e)制重特(te)大(da)生(sheng)產安(an)全事故為(wei)重點,堅持安(an)全第一、預(yu)防為(wei)主、綜合治理(li)(li)的(de)方針,加強領導(dao)(dao)、改(gai)革創新(xin),協(xie)調(diao)(diao)聯動、齊抓共(gong)管(guan),著力(li)強化企業(ye)安(an)全生(sheng)產主體(ti)(ti)責(ze)任(ren),著力(li)堵塞監督管(guan)理(li)(li)漏(lou)洞,著力(li)解決不遵守法(fa)(fa)律法(fa)(fa)規(gui)的(de)問題,依靠嚴(yan)密的(de)責(ze)任(ren)體(ti)(ti)系、嚴(yan)格(ge)的(de)法(fa)(fa)治措施、有效的(de)體(ti)(ti)制機制、有力(li)的(de)基礎保(bao)障和(he)(he)(he)完(wan)善的(de)系統(tong)治理(li)(li),切(qie)實增強安(an)全防范(fan)治理(li)(li)能力(li),大(da)力(li)提升我國安(an)全生(sheng)產整(zheng)體(ti)(ti)水平,確保(bao)人民(min)群(qun)眾安(an)康幸福、共(gong)享改(gai)革發(fa)展和(he)(he)(he)社會文明進步(bu)成果。

  (二)基(ji)本原則

  ——堅持安全(quan)發(fa)展(zhan)(zhan)。貫徹以人(ren)(ren)民為(wei)中心的發(fa)展(zhan)(zhan)思想(xiang),始終把人(ren)(ren)的生命(ming)安全(quan)放在首位,正確(que)處理安全(quan)與發(fa)展(zhan)(zhan)的關系,大力(li)實施(shi)安全(quan)發(fa)展(zhan)(zhan)戰略(lve),為(wei)經濟(ji)社會(hui)發(fa)展(zhan)(zhan)提供強有力(li)的安全(quan)保(bao)障。

  ——堅持(chi)改革創(chuang)新(xin)(xin)。不斷(duan)推進(jin)安全(quan)生(sheng)產(chan)理論(lun)創(chuang)新(xin)(xin)、制度創(chuang)新(xin)(xin)、體制機制創(chuang)新(xin)(xin)、科技創(chuang)新(xin)(xin)和(he)文化創(chuang)新(xin)(xin),增強企業內生(sheng)動力(li),激發全(quan)社(she)會創(chuang)新(xin)(xin)活力(li),破解安全(quan)生(sheng)產(chan)難題(ti),推動安全(quan)生(sheng)產(chan)與經濟社(she)會協調發展。

  ——堅持依法(fa)(fa)監管(guan)。大力弘揚社會主(zhu)義(yi)法(fa)(fa)治精神,運用法(fa)(fa)治思維(wei)和法(fa)(fa)治方式(shi),深(shen)化安全生(sheng)產監管(guan)執(zhi)法(fa)(fa)體(ti)制(zhi)改(gai)革,完善安全生(sheng)產法(fa)(fa)律法(fa)(fa)規和標準體(ti)系,嚴格規范(fan)公正文(wen)明(ming)執(zhi)法(fa)(fa),增強(qiang)監管(guan)執(zhi)法(fa)(fa)效能,提高安全生(sheng)產法(fa)(fa)治化水平。

  ——堅(jian)持源(yuan)頭防(fang)范。嚴格安(an)全(quan)(quan)生(sheng)產市場準入,經濟社會發(fa)展要以安(an)全(quan)(quan)為前提,把安(an)全(quan)(quan)生(sheng)產貫(guan)穿城鄉規劃布(bu)局(ju)、設(she)計、建設(she)、管理和企(qi)業生(sheng)產經營(ying)活動(dong)全(quan)(quan)過程。構建風險(xian)分級管控和隱患(huan)排(pai)查治理雙重預(yu)防(fang)工(gong)作機制,嚴防(fang)風險(xian)演變、隱患(huan)升級導致生(sheng)產安(an)全(quan)(quan)事故(gu)發(fa)生(sheng)。

  ——堅(jian)持系統(tong)治(zhi)理(li)(li)(li)。嚴密層(ceng)級治(zhi)理(li)(li)(li)和行業治(zhi)理(li)(li)(li)、政府治(zhi)理(li)(li)(li)、社(she)會(hui)治(zhi)理(li)(li)(li)相(xiang)結合的安全生(sheng)產(chan)治(zhi)理(li)(li)(li)體系,組織動員各(ge)方面力(li)量實施社(she)會(hui)共治(zhi)。綜合運用(yong)法律、行政、經濟、市場等(deng)手段,落實人防、技防、物防措(cuo)施,提升全社(she)會(hui)安全生(sheng)產(chan)治(zhi)理(li)(li)(li)能力(li)。

  (三)目標任務(wu)。到2020年,安(an)全(quan)(quan)生(sheng)產監管體(ti)制(zhi)機(ji)制(zhi)基(ji)本(ben)成熟,法律制(zhi)度基(ji)本(ben)完善,全(quan)(quan)國生(sheng)產安(an)全(quan)(quan)事(shi)故(gu)總量明顯(xian)減少,職業病危害防治取得積極(ji)進(jin)展,重特(te)大(da)(da)生(sheng)產安(an)全(quan)(quan)事(shi)故(gu)頻發勢頭(tou)得到有效遏(e)制(zhi),安(an)全(quan)(quan)生(sheng)產整體(ti)水(shui)平與全(quan)(quan)面建成小康社會目標相適應。到2030年,實現(xian)(xian)安(an)全(quan)(quan)生(sheng)產治理(li)(li)體(ti)系和治理(li)(li)能力現(xian)(xian)代化,全(quan)(quan)民安(an)全(quan)(quan)文明素質全(quan)(quan)面提升(sheng),安(an)全(quan)(quan)生(sheng)產保障能力顯(xian)著增強,為實現(xian)(xian)中華民族偉大(da)(da)復(fu)興的中國夢奠定(ding)穩固可靠的安(an)全(quan)(quan)生(sheng)產基(ji)礎。

  二、健全落實安全生產責任制

  (四(si))明(ming)確地方黨委和(he)政府(fu)領(ling)導責(ze)任(ren)。堅(jian)持黨政同責(ze)、一崗(gang)雙責(ze)、齊抓共管(guan)、失職追責(ze),完(wan)善安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)(chan)責(ze)任(ren)體系。地方各級黨委和(he)政府(fu)要(yao)(yao)始(shi)終(zhong)把(ba)安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)(chan)擺在重(zhong)要(yao)(yao)位置(zhi),加強組(zu)織領(ling)導。黨政主要(yao)(yao)負(fu)(fu)責(ze)人是本(ben)地區安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)(chan)第一責(ze)任(ren)人,班子其(qi)他成員(yuan)對(dui)分管(guan)范圍(wei)內的安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)(chan)工(gong)作(zuo)負(fu)(fu)領(ling)導責(ze)任(ren)。地方各級安(an)(an)(an)全(quan)(quan)生(sheng)產(chan)(chan)委員(yuan)會主任(ren)由(you)政府(fu)主要(yao)(yao)負(fu)(fu)責(ze)人擔任(ren),成員(yuan)由(you)同級黨委和(he)政府(fu)及(ji)相關部(bu)門負(fu)(fu)責(ze)人組(zu)成。

  地方各(ge)級黨委要認(ren)真貫徹(che)執行(xing)黨的(de)安(an)(an)(an)全生(sheng)產方針,在統攬(lan)本地區經(jing)濟社會發展全局中同步推進安(an)(an)(an)全生(sheng)產工(gong)作(zuo)(zuo),定期(qi)研究決定安(an)(an)(an)全生(sheng)產重大(da)問題。加強安(an)(an)(an)全生(sheng)產監(jian)管機構領導班子(zi)、干部(bu)隊伍建設(she)。嚴格安(an)(an)(an)全生(sheng)產履職績效考核和失職責任追究。強化(hua)安(an)(an)(an)全生(sheng)產宣傳教育和輿論引導。發揮(hui)人大(da)對(dui)安(an)(an)(an)全生(sheng)產工(gong)作(zuo)(zuo)的(de)監(jian)督促進作(zuo)(zuo)用、政(zheng)協對(dui)安(an)(an)(an)全生(sheng)產工(gong)作(zuo)(zuo)的(de)民主監(jian)督作(zuo)(zuo)用。推動(dong)組織、宣傳、政(zheng)法、機構編制等單位支持保(bao)障安(an)(an)(an)全生(sheng)產工(gong)作(zuo)(zuo)。動(dong)員(yuan)社會各(ge)界積極參與、支持、監(jian)督安(an)(an)(an)全生(sheng)產工(gong)作(zuo)(zuo)。

  地方各級政(zheng)府要(yao)把安(an)全(quan)(quan)(quan)生(sheng)產納入(ru)經濟社會(hui)發(fa)展總體規劃,制定實(shi)施(shi)安(an)全(quan)(quan)(quan)生(sheng)產專(zhuan)項規劃,健全(quan)(quan)(quan)安(an)全(quan)(quan)(quan)投入(ru)保障制度(du)。及時研究部(bu)署安(an)全(quan)(quan)(quan)生(sheng)產工(gong)作,嚴格(ge)落(luo)實(shi)屬地監(jian)管(guan)責任(ren)。充分發(fa)揮安(an)全(quan)(quan)(quan)生(sheng)產委員會(hui)作用,實(shi)施(shi)安(an)全(quan)(quan)(quan)生(sheng)產責任(ren)目標管(guan)理(li)。建立安(an)全(quan)(quan)(quan)生(sheng)產巡查(cha)制度(du),督促各部(bu)門和下(xia)級政(zheng)府履(lv)職盡責。加強(qiang)(qiang)安(an)全(quan)(quan)(quan)生(sheng)產監(jian)管(guan)執法能力(li)建設,推進安(an)全(quan)(quan)(quan)科技(ji)創新(xin),提升信息(xi)化管(guan)理(li)水平。嚴格(ge)安(an)全(quan)(quan)(quan)準入(ru)標準,指導(dao)管(guan)控(kong)安(an)全(quan)(quan)(quan)風險,督促整治重大隱(yin)患,強(qiang)(qiang)化源(yuan)頭治理(li)。加強(qiang)(qiang)應急管(guan)理(li),完善安(an)全(quan)(quan)(quan)生(sheng)產應急救援(yuan)體系(xi)。依法依規開展事故(gu)調(diao)查(cha)處理(li),督促落(luo)實(shi)問題整改(gai)。

  (五(wu))明確部(bu)(bu)門(men)(men)監(jian)管(guan)(guan)(guan)(guan)責(ze)(ze)任。按照管(guan)(guan)(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)必須管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)(quan)、管(guan)(guan)(guan)(guan)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)務(wu)必須管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)(quan)、管(guan)(guan)(guan)(guan)生(sheng)(sheng)(sheng)產(chan)經營必須管(guan)(guan)(guan)(guan)安(an)(an)(an)全(quan)(quan)(quan)和誰主管(guan)(guan)(guan)(guan)誰負(fu)責(ze)(ze)的(de)(de)(de)原則,厘清安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)綜合監(jian)管(guan)(guan)(guan)(guan)與行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)監(jian)管(guan)(guan)(guan)(guan)的(de)(de)(de)關(guan)(guan)系,明確各有關(guan)(guan)部(bu)(bu)門(men)(men)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)和職(zhi)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)健康(kang)工(gong)作(zuo)職(zhi)責(ze)(ze),并(bing)落實到部(bu)(bu)門(men)(men)工(gong)作(zuo)職(zhi)責(ze)(ze)規(gui)定中。安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)監(jian)督(du)(du)管(guan)(guan)(guan)(guan)理部(bu)(bu)門(men)(men)負(fu)責(ze)(ze)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)法規(gui)標準(zhun)和政策(ce)規(gui)劃(hua)制定修訂、執(zhi)法監(jian)督(du)(du)、事(shi)故(gu)調(diao)查處理、應急救(jiu)援管(guan)(guan)(guan)(guan)理、統計分析、宣傳教育培訓等(deng)綜合性工(gong)作(zuo),承(cheng)擔職(zhi)責(ze)(ze)范圍(wei)內(nei)行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)領(ling)(ling)域安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)和職(zhi)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)健康(kang)監(jian)管(guan)(guan)(guan)(guan)執(zhi)法職(zhi)責(ze)(ze)。負(fu)有安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)監(jian)督(du)(du)管(guan)(guan)(guan)(guan)理職(zhi)責(ze)(ze)的(de)(de)(de)有關(guan)(guan)部(bu)(bu)門(men)(men)依法依規(gui)履行(xing)(xing)相關(guan)(guan)行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)領(ling)(ling)域安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)和職(zhi)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)健康(kang)監(jian)管(guan)(guan)(guan)(guan)職(zhi)責(ze)(ze),強化監(jian)管(guan)(guan)(guan)(guan)執(zhi)法,嚴(yan)厲(li)查處違(wei)法違(wei)規(gui)行(xing)(xing)為(wei)。其他行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)領(ling)(ling)域主管(guan)(guan)(guan)(guan)部(bu)(bu)門(men)(men)負(fu)有安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)管(guan)(guan)(guan)(guan)理責(ze)(ze)任,要將(jiang)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)工(gong)作(zuo)作(zuo)為(wei)行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)領(ling)(ling)域管(guan)(guan)(guan)(guan)理的(de)(de)(de)重要內(nei)容(rong),從行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)規(gui)劃(hua)、產(chan)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)政策(ce)、法規(gui)標準(zhun)、行(xing)(xing)政許(xu)可等(deng)方面加(jia)強行(xing)(xing)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)工(gong)作(zuo),指導(dao)督(du)(du)促企事(shi)業(ye)(ye)(ye)(ye)(ye)(ye)(ye)單(dan)位加(jia)強安(an)(an)(an)全(quan)(quan)(quan)管(guan)(guan)(guan)(guan)理。黨委和政府其他有關(guan)(guan)部(bu)(bu)門(men)(men)要在職(zhi)責(ze)(ze)范圍(wei)內(nei)為(wei)安(an)(an)(an)全(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)工(gong)作(zuo)提供支持保障,共同推進(jin)安(an)(an)(an)全(quan)(quan)(quan)發展(zhan)。

  (六)嚴格落實(shi)(shi)(shi)企(qi)(qi)業(ye)(ye)主體責(ze)(ze)(ze)任。企(qi)(qi)業(ye)(ye)對本單(dan)位安(an)全(quan)(quan)(quan)生(sheng)產(chan)和(he)職業(ye)(ye)健(jian)康(kang)工作(zuo)負(fu)全(quan)(quan)(quan)面責(ze)(ze)(ze)任,要(yao)嚴格履(lv)行安(an)全(quan)(quan)(quan)生(sheng)產(chan)法定責(ze)(ze)(ze)任,建立健(jian)全(quan)(quan)(quan)自我(wo)約(yue)束、持續改進的內(nei)生(sheng)機制。企(qi)(qi)業(ye)(ye)實(shi)(shi)(shi)行全(quan)(quan)(quan)員安(an)全(quan)(quan)(quan)生(sheng)產(chan)責(ze)(ze)(ze)任制度,法定代(dai)表人(ren)和(he)實(shi)(shi)(shi)際控制人(ren)同為安(an)全(quan)(quan)(quan)生(sheng)產(chan)第一責(ze)(ze)(ze)任人(ren),主要(yao)技術(shu)負(fu)責(ze)(ze)(ze)人(ren)負(fu)有(you)(you)安(an)全(quan)(quan)(quan)生(sheng)產(chan)技術(shu)決策和(he)指(zhi)揮權(quan),強化部(bu)門(men)安(an)全(quan)(quan)(quan)生(sheng)產(chan)職責(ze)(ze)(ze),落實(shi)(shi)(shi)一崗雙責(ze)(ze)(ze)。完善落實(shi)(shi)(shi)混合所有(you)(you)制企(qi)(qi)業(ye)(ye)以及跨地區、多(duo)層級和(he)境外中資(zi)企(qi)(qi)業(ye)(ye)投資(zi)主體的安(an)全(quan)(quan)(quan)生(sheng)產(chan)責(ze)(ze)(ze)任。建立企(qi)(qi)業(ye)(ye)全(quan)(quan)(quan)過程安(an)全(quan)(quan)(quan)生(sheng)產(chan)和(he)職業(ye)(ye)健(jian)康(kang)管(guan)理制度,做到安(an)全(quan)(quan)(quan)責(ze)(ze)(ze)任、管(guan)理、投入、培訓(xun)和(he)應急救援“五到位”。國有(you)(you)企(qi)(qi)業(ye)(ye)要(yao)發揮安(an)全(quan)(quan)(quan)生(sheng)產(chan)工作(zuo)示(shi)范帶頭(tou)作(zuo)用,自覺(jue)接(jie)受屬地監管(guan)。

  (七)健全(quan)責任考(kao)(kao)(kao)核(he)機制(zhi)。建立與全(quan)面建成小康社會(hui)相適應和(he)體(ti)現安(an)(an)全(quan)發展水平的考(kao)(kao)(kao)核(he)評價體(ti)系。完(wan)善考(kao)(kao)(kao)核(he)制(zhi)度,統籌整合、科學設(she)定(ding)安(an)(an)全(quan)生(sheng)(sheng)產考(kao)(kao)(kao)核(he)指標,加(jia)大安(an)(an)全(quan)生(sheng)(sheng)產在社會(hui)治(zhi)安(an)(an)綜合治(zhi)理、精(jing)神文明建設(she)等考(kao)(kao)(kao)核(he)中的權重。各(ge)級政府要(yao)對同級安(an)(an)全(quan)生(sheng)(sheng)產委員會(hui)成員單位和(he)下級政府實(shi)施嚴格的安(an)(an)全(quan)生(sheng)(sheng)產工作責任考(kao)(kao)(kao)核(he),實(shi)行過程考(kao)(kao)(kao)核(he)與結果考(kao)(kao)(kao)核(he)相結合。各(ge)地區各(ge)單位要(yao)建立安(an)(an)全(quan)生(sheng)(sheng)產績效與履職評定(ding)、職務晉(jin)升、獎勵懲處掛鉤制(zhi)度,嚴格落實(shi)安(an)(an)全(quan)生(sheng)(sheng)產“一票否決(jue)”制(zhi)度。

  (八(ba))嚴(yan)格(ge)責(ze)(ze)任(ren)(ren)追(zhui)究(jiu)制度(du)。實(shi)行黨政(zheng)(zheng)領導干(gan)部任(ren)(ren)期安(an)全(quan)生(sheng)(sheng)(sheng)(sheng)產責(ze)(ze)任(ren)(ren)制,日常工作依(yi)(yi)(yi)責(ze)(ze)盡職、發生(sheng)(sheng)(sheng)(sheng)事(shi)(shi)(shi)故依(yi)(yi)(yi)責(ze)(ze)追(zhui)究(jiu)。依(yi)(yi)(yi)法(fa)(fa)(fa)依(yi)(yi)(yi)規(gui)制定(ding)各(ge)有(you)關部門安(an)全(quan)生(sheng)(sheng)(sheng)(sheng)產權力和(he)責(ze)(ze)任(ren)(ren)清單,盡職照單免責(ze)(ze)、失(shi)(shi)職照單問責(ze)(ze)。建立企業(ye)(ye)生(sheng)(sheng)(sheng)(sheng)產經(jing)營(ying)全(quan)過程安(an)全(quan)責(ze)(ze)任(ren)(ren)追(zhui)溯制度(du)。嚴(yan)肅查處安(an)全(quan)生(sheng)(sheng)(sheng)(sheng)產領域項目審批、行政(zheng)(zheng)許(xu)可、監(jian)管(guan)執法(fa)(fa)(fa)中的失(shi)(shi)職瀆職和(he)權錢(qian)交(jiao)易等腐敗行為。嚴(yan)格(ge)事(shi)(shi)(shi)故直報(bao)(bao)制度(du),對(dui)瞞報(bao)(bao)、謊報(bao)(bao)、漏報(bao)(bao)、遲報(bao)(bao)事(shi)(shi)(shi)故的單位和(he)個人(ren)依(yi)(yi)(yi)法(fa)(fa)(fa)依(yi)(yi)(yi)規(gui)追(zhui)責(ze)(ze)。對(dui)被追(zhui)究(jiu)刑事(shi)(shi)(shi)責(ze)(ze)任(ren)(ren)的生(sheng)(sheng)(sheng)(sheng)產經(jing)營(ying)者依(yi)(yi)(yi)法(fa)(fa)(fa)實(shi)施(shi)相(xiang)應(ying)的職業(ye)(ye)禁入(ru),對(dui)事(shi)(shi)(shi)故發生(sheng)(sheng)(sheng)(sheng)負有(you)重大責(ze)(ze)任(ren)(ren)的社會服務機(ji)構(gou)和(he)人(ren)員依(yi)(yi)(yi)法(fa)(fa)(fa)嚴(yan)肅追(zhui)究(jiu)法(fa)(fa)(fa)律(lv)責(ze)(ze)任(ren)(ren),并(bing)依(yi)(yi)(yi)法(fa)(fa)(fa)實(shi)施(shi)相(xiang)應(ying)的行業(ye)(ye)禁入(ru)。

  三、改革安全監管監察體制

  (九)完善(shan)監(jian)(jian)督管(guan)(guan)理體(ti)制(zhi)。加強各級(ji)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)委員(yuan)會組織領導,充(chong)分發揮其統籌協調作(zuo)(zuo)用,切實解決(jue)突出矛盾(dun)和(he)問題。各級(ji)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)監(jian)(jian)督管(guan)(guan)理部(bu)門(men)承擔本級(ji)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)委員(yuan)會日常工(gong)作(zuo)(zuo),負責(ze)指導協調、監(jian)(jian)督檢查(cha)、巡(xun)查(cha)考核(he)本級(ji)政府有關(guan)(guan)部(bu)門(men)和(he)下級(ji)政府安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)工(gong)作(zuo)(zuo),履行綜合監(jian)(jian)管(guan)(guan)職(zhi)責(ze)。負有安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)監(jian)(jian)督管(guan)(guan)理職(zhi)責(ze)的部(bu)門(men),依照有關(guan)(guan)法律(lv)法規和(he)部(bu)門(men)職(zhi)責(ze),健全(quan)(quan)(quan)(quan)(quan)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)監(jian)(jian)管(guan)(guan)體(ti)制(zhi),嚴(yan)格落實監(jian)(jian)管(guan)(guan)職(zhi)責(ze)。相關(guan)(guan)部(bu)門(men)按照各自職(zhi)責(ze)建立完善(shan)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)工(gong)作(zuo)(zuo)機制(zhi),形成齊抓共管(guan)(guan)格局。堅(jian)持管(guan)(guan)安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)必須管(guan)(guan)職(zhi)業健康,建立安(an)(an)全(quan)(quan)(quan)(quan)(quan)生(sheng)(sheng)(sheng)產(chan)和(he)職(zhi)業健康一體(ti)化監(jian)(jian)管(guan)(guan)執法體(ti)制(zhi)。

  (十)改(gai)革重點(dian)行業領域(yu)安(an)(an)(an)全(quan)監(jian)(jian)(jian)管(guan)監(jian)(jian)(jian)察體(ti)制(zhi)(zhi)。依托國家煤礦安(an)(an)(an)全(quan)監(jian)(jian)(jian)察體(ti)制(zhi)(zhi),加(jia)強(qiang)非煤礦山安(an)(an)(an)全(quan)生產監(jian)(jian)(jian)管(guan)監(jian)(jian)(jian)察,優(you)化安(an)(an)(an)全(quan)監(jian)(jian)(jian)察機(ji)構(gou)布局,將國家煤礦安(an)(an)(an)全(quan)監(jian)(jian)(jian)察機(ji)構(gou)負責(ze)的(de)安(an)(an)(an)全(quan)生產行政(zheng)許(xu)可(ke)事(shi)項(xiang)移交給地(di)方政(zheng)府承擔(dan)。著重加(jia)強(qiang)危(wei)險(xian)化學品安(an)(an)(an)全(quan)監(jian)(jian)(jian)管(guan)體(ti)制(zhi)(zhi)改(gai)革和(he)力(li)(li)量建(jian)設,明確(que)和(he)落實(shi)危(wei)險(xian)化學品建(jian)設項(xiang)目立項(xiang)、規劃(hua)、設計(ji)、施工及生產、儲存、使(shi)用、銷(xiao)售、運輸、廢棄處置等(deng)環(huan)節的(de)法定安(an)(an)(an)全(quan)監(jian)(jian)(jian)管(guan)責(ze)任(ren),建(jian)立有力(li)(li)的(de)協調聯動機(ji)制(zhi)(zhi),消除監(jian)(jian)(jian)管(guan)空白(bai)。完善(shan)海(hai)洋(yang)石油安(an)(an)(an)全(quan)生產監(jian)(jian)(jian)督管(guan)理(li)體(ti)制(zhi)(zhi)機(ji)制(zhi)(zhi),實(shi)行政(zheng)企分開。理(li)順民航、鐵路、電力(li)(li)等(deng)行業跨區域(yu)監(jian)(jian)(jian)管(guan)體(ti)制(zhi)(zhi),明確(que)行業監(jian)(jian)(jian)管(guan)、區域(yu)監(jian)(jian)(jian)管(guan)與(yu)地(di)方監(jian)(jian)(jian)管(guan)職責(ze)。

  (十一(yi))進(jin)一(yi)步完善地方(fang)(fang)監管(guan)(guan)執(zhi)法體制(zhi)。地方(fang)(fang)各級黨委(wei)和政府(fu)要(yao)將安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)監督管(guan)(guan)理(li)部(bu)門(men)(men)作(zuo)為政府(fu)工(gong)作(zuo)部(bu)門(men)(men)和行(xing)政執(zhi)法機(ji)構,加強(qiang)安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)執(zhi)法隊伍建設,強(qiang)化(hua)行(xing)政執(zhi)法職能。統籌(chou)加強(qiang)安(an)(an)(an)全(quan)(quan)(quan)(quan)監管(guan)(guan)力(li)量,重點充實市(shi)、縣兩級安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)監管(guan)(guan)執(zhi)法人員(yuan),強(qiang)化(hua)鄉鎮(街道)安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)監管(guan)(guan)力(li)量建設。完善各類開發區(qu)(qu)、工(gong)業園區(qu)(qu)、港區(qu)(qu)、風景區(qu)(qu)等(deng)功能區(qu)(qu)安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)監管(guan)(guan)體制(zhi),明確負(fu)責(ze)安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)監督管(guan)(guan)理(li)的機(ji)構,以及港區(qu)(qu)安(an)(an)(an)全(quan)(quan)(quan)(quan)生產(chan)(chan)地方(fang)(fang)監管(guan)(guan)和部(bu)門(men)(men)監管(guan)(guan)責(ze)任(ren)。

  (十二)健全應(ying)急(ji)救(jiu)援管(guan)理體制(zhi)。按(an)照政事分開原(yuan)則,推進安全生產應(ying)急(ji)救(jiu)援管(guan)理體制(zhi)改革,強化(hua)行(xing)政管(guan)理職能,提高組織協調能力和(he)現場救(jiu)援時效。健全省、市(shi)、縣(xian)三(san)級安全生產應(ying)急(ji)救(jiu)援管(guan)理工作機制(zhi),建設聯動互(hu)通的應(ying)急(ji)救(jiu)援指揮平臺。依托公安消防、大型企業、工業園區等(deng)應(ying)急(ji)救(jiu)援力量,加(jia)強礦(kuang)山和(he)危險化(hua)學品(pin)等(deng)應(ying)急(ji)救(jiu)援基(ji)地和(he)隊伍建設,實行(xing)區域化(hua)應(ying)急(ji)救(jiu)援資源共享。

  四、大力推進依法治理

  (十三)健(jian)全(quan)法(fa)(fa)律(lv)法(fa)(fa)規(gui)體系。建立(li)健(jian)全(quan)安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)律(lv)法(fa)(fa)規(gui)立(li)改廢釋工(gong)作協調(diao)機制。加強(qiang)(qiang)涉及安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)相關法(fa)(fa)規(gui)一(yi)致性(xing)(xing)審查(cha),增強(qiang)(qiang)安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)制建設的(de)系統性(xing)(xing)、可操作性(xing)(xing)。制定安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)中長期立(li)法(fa)(fa)規(gui)劃(hua),加快制定修(xiu)訂安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)法(fa)(fa)配(pei)套法(fa)(fa)規(gui)。加強(qiang)(qiang)安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)和(he)職業健(jian)康法(fa)(fa)律(lv)法(fa)(fa)規(gui)銜(xian)接融合(he)。研究修(xiu)改刑(xing)法(fa)(fa)有關條款,將(jiang)生(sheng)產(chan)(chan)(chan)經(jing)營過程(cheng)中極易(yi)導致重(zhong)大(da)生(sheng)產(chan)(chan)(chan)安(an)(an)(an)(an)全(quan)事(shi)故的(de)違法(fa)(fa)行為(wei)列(lie)入刑(xing)法(fa)(fa)調(diao)整范圍。制定完善高危(wei)行業領域(yu)(yu)安(an)(an)(an)(an)全(quan)規(gui)程(cheng)。設區的(de)市根據立(li)法(fa)(fa)法(fa)(fa)的(de)立(li)法(fa)(fa)精神(shen),加強(qiang)(qiang)安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)地(di)方性(xing)(xing)法(fa)(fa)規(gui)建設,解決區域(yu)(yu)性(xing)(xing)安(an)(an)(an)(an)全(quan)生(sheng)產(chan)(chan)(chan)突出問題。

  (十四(si))完善標(biao)準(zhun)(zhun)(zhun)體(ti)(ti)系(xi)。加快安(an)(an)全(quan)生(sheng)產(chan)(chan)標(biao)準(zhun)(zhun)(zhun)制定修訂和(he)整合(he),建立以強(qiang)制性(xing)國(guo)家標(biao)準(zhun)(zhun)(zhun)為(wei)主(zhu)體(ti)(ti)的安(an)(an)全(quan)生(sheng)產(chan)(chan)標(biao)準(zhun)(zhun)(zhun)體(ti)(ti)系(xi)。鼓(gu)勵(li)依(yi)法(fa)成立的社會團體(ti)(ti)和(he)企業制定更加嚴格規范的安(an)(an)全(quan)生(sheng)產(chan)(chan)標(biao)準(zhun)(zhun)(zhun),結合(he)國(guo)情積極借鑒實施國(guo)際先進標(biao)準(zhun)(zhun)(zhun)。國(guo)務院(yuan)安(an)(an)全(quan)生(sheng)產(chan)(chan)監督(du)管理(li)(li)部(bu)門負責生(sheng)產(chan)(chan)經營(ying)單位職業危害預(yu)防治理(li)(li)國(guo)家標(biao)準(zhun)(zhun)(zhun)制定發布(bu)工(gong)作;統籌提出安(an)(an)全(quan)生(sheng)產(chan)(chan)強(qiang)制性(xing)國(guo)家標(biao)準(zhun)(zhun)(zhun)立項計劃,有關部(bu)門按照職責分工(gong)組(zu)織起草、審查、實施和(he)監督(du)執行,國(guo)務院(yuan)標(biao)準(zhun)(zhun)(zhun)化(hua)行政主(zhu)管部(bu)門負責及時(shi)立項、編號(hao)、對外通報、批準(zhun)(zhun)(zhun)并發布(bu)。

  (十五)嚴(yan)格(ge)安(an)全(quan)準(zhun)入(ru)制度(du)。嚴(yan)格(ge)高危行(xing)業領域安(an)全(quan)準(zhun)入(ru)條件。按照強化監(jian)管(guan)與便民服務相(xiang)(xiang)結(jie)合原則,科(ke)學設置安(an)全(quan)生產行(xing)政許(xu)可事(shi)(shi)(shi)項(xiang)和辦理(li)(li)(li)程序,優化工作流(liu)程,簡(jian)化辦事(shi)(shi)(shi)環節,實施網上公(gong)開辦理(li)(li)(li),接受社會監(jian)督(du)。對(dui)與人(ren)民群眾(zhong)生命財產安(an)全(quan)直接相(xiang)(xiang)關的行(xing)政許(xu)可事(shi)(shi)(shi)項(xiang),依法嚴(yan)格(ge)管(guan)理(li)(li)(li)。對(dui)取消、下(xia)放(fang)、移交的行(xing)政許(xu)可事(shi)(shi)(shi)項(xiang),要加強事(shi)(shi)(shi)中事(shi)(shi)(shi)后安(an)全(quan)監(jian)管(guan)。

  (十六)規(gui)范監(jian)(jian)管執(zhi)法(fa)(fa)行(xing)(xing)為。完善(shan)安(an)全(quan)生(sheng)產(chan)監(jian)(jian)管執(zhi)法(fa)(fa)制(zhi)(zhi)度,明(ming)確每(mei)個生(sheng)產(chan)經營單(dan)位(wei)安(an)全(quan)生(sheng)產(chan)監(jian)(jian)督(du)和管理(li)主體(ti),制(zhi)(zhi)定(ding)實施執(zhi)法(fa)(fa)計劃,完善(shan)執(zhi)法(fa)(fa)程序規(gui)定(ding),依法(fa)(fa)嚴格查(cha)(cha)處各類違法(fa)(fa)違規(gui)行(xing)(xing)為。建立行(xing)(xing)政(zheng)執(zhi)法(fa)(fa)和刑事(shi)司法(fa)(fa)銜接制(zhi)(zhi)度,負有安(an)全(quan)生(sheng)產(chan)監(jian)(jian)督(du)管理(li)職責(ze)的(de)(de)部(bu)門要加強與公安(an)、檢察院、法(fa)(fa)院等協調配合,完善(shan)安(an)全(quan)生(sheng)產(chan)違法(fa)(fa)線索通報(bao)、案件(jian)移送(song)與協查(cha)(cha)機(ji)制(zhi)(zhi)。對違法(fa)(fa)行(xing)(xing)為當事(shi)人拒(ju)不(bu)執(zhi)行(xing)(xing)安(an)全(quan)生(sheng)產(chan)行(xing)(xing)政(zheng)執(zhi)法(fa)(fa)決(jue)定(ding)的(de)(de),負有安(an)全(quan)生(sheng)產(chan)監(jian)(jian)督(du)管理(li)職責(ze)的(de)(de)部(bu)門應依法(fa)(fa)申請司法(fa)(fa)機(ji)關(guan)強制(zhi)(zhi)執(zhi)行(xing)(xing)。完善(shan)司法(fa)(fa)機(ji)關(guan)參與事(shi)故(gu)調查(cha)(cha)機(ji)制(zhi)(zhi),嚴肅(su)查(cha)(cha)處違法(fa)(fa)犯罪行(xing)(xing)為。研究建立安(an)全(quan)生(sheng)產(chan)民(min)事(shi)和行(xing)(xing)政(zheng)公益訴訟制(zhi)(zhi)度。

  (十七(qi))完善執法(fa)(fa)(fa)監(jian)(jian)督機制。各(ge)級人(ren)大常委(wei)會要定(ding)期檢(jian)查安(an)全生(sheng)產(chan)(chan)法(fa)(fa)(fa)律法(fa)(fa)(fa)規實施(shi)情況,開(kai)展專題詢(xun)問(wen)。各(ge)級政協要圍繞安(an)全生(sheng)產(chan)(chan)突(tu)出問(wen)題開(kai)展民主監(jian)(jian)督和協商調研。建立執法(fa)(fa)(fa)行為審議(yi)制度和重大行政執法(fa)(fa)(fa)決策機制,評估(gu)執法(fa)(fa)(fa)效果(guo),防止濫用職權。健全領導干(gan)部非法(fa)(fa)(fa)干(gan)預安(an)全生(sheng)產(chan)(chan)監(jian)(jian)管執法(fa)(fa)(fa)的記錄、通報(bao)和責(ze)任追究制度。完善安(an)全生(sheng)產(chan)(chan)執法(fa)(fa)(fa)糾錯和執法(fa)(fa)(fa)信息公(gong)開(kai)制度,加(jia)強社會監(jian)(jian)督和輿論監(jian)(jian)督,保證執法(fa)(fa)(fa)嚴明、有錯必糾。

  (十九)完(wan)善(shan)事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)處(chu)理機(ji)制。堅(jian)持問責與整改(gai)(gai)(gai)并重,充分(fen)發揮事(shi)(shi)故查(cha)處(chu)對加強(qiang)和(he)(he)(he)改(gai)(gai)(gai)進安全(quan)生(sheng)產工(gong)作(zuo)的(de)促進作(zuo)用。完(wan)善(shan)生(sheng)產安全(quan)事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)組組長(chang)負責制。健全(quan)典(dian)型事(shi)(shi)故提級調(diao)(diao)(diao)(diao)查(cha)、跨地區協同(tong)調(diao)(diao)(diao)(diao)查(cha)和(he)(he)(he)工(gong)作(zuo)督導機(ji)制。建立(li)事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)分(fen)析(xi)技術(shu)支撐(cheng)體系(xi),所有(you)(you)事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)報告要設立(li)技術(shu)和(he)(he)(he)管理問題專(zhuan)篇,詳細分(fen)析(xi)原因并全(quan)文發布,做(zuo)好解讀,回應公眾關切。對事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)發現有(you)(you)漏洞(dong)、缺(que)陷的(de)有(you)(you)關法(fa)(fa)律法(fa)(fa)規(gui)和(he)(he)(he)標準制度(du)(du),及時啟動制定修訂(ding)工(gong)作(zuo)。建立(li)事(shi)(shi)故暴露問題整改(gai)(gai)(gai)督辦(ban)制度(du)(du),事(shi)(shi)故結(jie)案后一年(nian)內,負責事(shi)(shi)故調(diao)(diao)(diao)(diao)查(cha)的(de)地方政府和(he)(he)(he)國務院有(you)(you)關部(bu)門(men)要組織開(kai)展評估(gu),及時向(xiang)社會公開(kai),對履(lv)職不力、整改(gai)(gai)(gai)措施不落實的(de),依法(fa)(fa)依規(gui)嚴肅追究有(you)(you)關單位和(he)(he)(he)人(ren)員責任(ren)。

  五、建立安全預防控制體系

  (二十(shi))加強(qiang)安(an)全風(feng)險管(guan)控(kong)。地方各(ge)級政(zheng)府要建(jian)立(li)(li)完(wan)善(shan)安(an)全風(feng)險評估與論證機制(zhi)(zhi),科(ke)學合理確(que)定企業(ye)選址和(he)(he)(he)基(ji)礎設施建(jian)設、居民生活區空(kong)間布局。高(gao)危(wei)項(xiang)目(mu)審批(pi)必須把安(an)全生產作為前置條件(jian),城鄉規劃布局、設計、建(jian)設、管(guan)理等各(ge)項(xiang)工(gong)作必須以安(an)全為前提,實(shi)行(xing)(xing)重(zhong)(zhong)(zhong)大安(an)全風(feng)險“一票(piao)否決”。加強(qiang)新(xin)材料、新(xin)工(gong)藝、新(xin)業(ye)態安(an)全風(feng)險評估和(he)(he)(he)管(guan)控(kong)。緊密(mi)結(jie)合供(gong)給側結(jie)構性改(gai)革,推動高(gao)危(wei)產業(ye)轉型升級。位(wei)置相(xiang)鄰、行(xing)(xing)業(ye)相(xiang)近、業(ye)態相(xiang)似的地區和(he)(he)(he)行(xing)(xing)業(ye)要建(jian)立(li)(li)完(wan)善(shan)重(zhong)(zhong)(zhong)大安(an)全風(feng)險聯防聯控(kong)機制(zhi)(zhi)。構建(jian)國家、省、市、縣四級重(zhong)(zhong)(zhong)大危(wei)險源信息管(guan)理體(ti)系(xi),對(dui)重(zhong)(zhong)(zhong)點行(xing)(xing)業(ye)、重(zhong)(zhong)(zhong)點區域(yu)、重(zhong)(zhong)(zhong)點企業(ye)實(shi)行(xing)(xing)風(feng)險預警控(kong)制(zhi)(zhi),有(you)效防范重(zhong)(zhong)(zhong)特大生產安(an)全事(shi)故(gu)。

  (二(er)十一)強化(hua)企(qi)業(ye)(ye)(ye)預防措施。企(qi)業(ye)(ye)(ye)要定(ding)(ding)期開展風險(xian)(xian)評(ping)估和(he)危害辨識。針對(dui)高危工藝、設(she)備(bei)、物品、場(chang)所和(he)崗位(wei),建(jian)(jian)立分級管控(kong)制(zhi)度,制(zhi)定(ding)(ding)落實(shi)安(an)(an)(an)全(quan)操(cao)作規程。樹(shu)立隱患(huan)就是事(shi)故的(de)觀念,建(jian)(jian)立健全(quan)隱患(huan)排查治理(li)制(zhi)度、重大隱患(huan)治理(li)情況向負有安(an)(an)(an)全(quan)生(sheng)產監督管理(li)職責的(de)部門和(he)企(qi)業(ye)(ye)(ye)職代會“雙(shuang)報告”制(zhi)度,實(shi)行自查自改自報閉環管理(li)。嚴格執行安(an)(an)(an)全(quan)生(sheng)產和(he)職業(ye)(ye)(ye)健康(kang)“三(san)同(tong)時”制(zhi)度。大力(li)推進企(qi)業(ye)(ye)(ye)安(an)(an)(an)全(quan)生(sheng)產標準(zhun)化(hua)建(jian)(jian)設(she),實(shi)現(xian)安(an)(an)(an)全(quan)管理(li)、操(cao)作行為、設(she)備(bei)設(she)施和(he)作業(ye)(ye)(ye)環境的(de)標準(zhun)化(hua)。開展經常性(xing)的(de)應急演練(lian)和(he)人員避險(xian)(xian)自救培訓,著力(li)提升現(xian)場(chang)應急處置(zhi)能力(li)。

  (二十二)建立隱(yin)患(huan)(huan)治(zhi)理(li)監督(du)機(ji)制(zhi)。制(zhi)定(ding)(ding)生(sheng)產(chan)安(an)全事(shi)(shi)故(gu)隱(yin)患(huan)(huan)分(fen)級和排(pai)查(cha)(cha)治(zhi)理(li)標準。負(fu)有安(an)全生(sheng)產(chan)監督(du)管(guan)理(li)職責(ze)的部門要建立與企(qi)(qi)業隱(yin)患(huan)(huan)排(pai)查(cha)(cha)治(zhi)理(li)系統聯網的信息(xi)平(ping)臺,完(wan)善線上線下配套監管(guan)制(zhi)度(du)(du)。強化隱(yin)患(huan)(huan)排(pai)查(cha)(cha)治(zhi)理(li)監督(du)執法,對(dui)(dui)重(zhong)大(da)隱(yin)患(huan)(huan)整(zheng)改不到位的企(qi)(qi)業依(yi)法采取停產(chan)停業、停止施(shi)工、停止供電和查(cha)(cha)封扣押等強制(zhi)措施(shi),按(an)規(gui)定(ding)(ding)給予上限經濟處罰,對(dui)(dui)構成犯罪(zui)的要移(yi)交(jiao)司法機(ji)關依(yi)法追究刑事(shi)(shi)責(ze)任。嚴格重(zhong)大(da)隱(yin)患(huan)(huan)掛牌(pai)督(du)辦制(zhi)度(du)(du),對(dui)(dui)整(zheng)改和督(du)辦不力的納入政府核查(cha)(cha)問責(ze)范(fan)圍,實行約談告誡、公(gong)開曝光,情節(jie)嚴重(zhong)的依(yi)法依(yi)規(gui)追究相(xiang)關人員責(ze)任。

  (二十三)強化(hua)(hua)城(cheng)市(shi)運(yun)行安全(quan)保障。定期排(pai)查區域(yu)內安全(quan)風(feng)險點、危險源,落實(shi)管(guan)(guan)控措施(shi),構建(jian)(jian)系(xi)統性、現代化(hua)(hua)的城(cheng)市(shi)安全(quan)保障體(ti)系(xi),推進安全(quan)發展示(shi)范城(cheng)市(shi)建(jian)(jian)設(she)(she)(she)。提高(gao)基礎設(she)(she)(she)施(shi)安全(quan)配置標準,重點加(jia)強對(dui)城(cheng)市(shi)高(gao)層建(jian)(jian)筑(zhu)、大(da)型(xing)(xing)綜合(he)體(ti)、隧道橋梁、管(guan)(guan)線管(guan)(guan)廊、軌道交(jiao)通(tong)、燃(ran)氣(qi)、電力(li)設(she)(she)(she)施(shi)及電梯、游樂設(she)(she)(she)施(shi)等(deng)的檢測維護。完善大(da)型(xing)(xing)群眾性活動安全(quan)管(guan)(guan)理制(zhi)度,加(jia)強人員(yuan)密(mi)集場(chang)所安全(quan)監(jian)管(guan)(guan)。加(jia)強公安、民政、國土資源、住房城(cheng)鄉建(jian)(jian)設(she)(she)(she)、交(jiao)通(tong)運(yun)輸(shu)、水(shui)利、農業、安全(quan)監(jian)管(guan)(guan)、氣(qi)象、地(di)震等(deng)相(xiang)關(guan)部(bu)門的協調聯動,嚴(yan)防自然(ran)災害(hai)引發事故(gu)。

  (二(er)十四)加(jia)強(qiang)重點領(ling)域(yu)工程(cheng)治理。深入(ru)推進對煤(mei)礦(kuang)瓦斯、水害等(deng)重大災(zai)害以及礦(kuang)山采(cai)空區(qu)、尾礦(kuang)庫的工程(cheng)治理。加(jia)快實(shi)施人口密集(ji)區(qu)域(yu)的危險化學品(pin)和化工企業(ye)生(sheng)產、倉儲場(chang)所安全(quan)(quan)搬遷工程(cheng)。深化油(you)氣開采(cai)、輸送、煉化、碼頭接卸等(deng)領(ling)域(yu)安全(quan)(quan)整(zheng)治。實(shi)施高速公(gong)路、鄉村公(gong)路和急彎陡坡、臨水臨崖危險路段公(gong)路安全(quan)(quan)生(sheng)命(ming)防護(hu)工程(cheng)建設。加(jia)強(qiang)高速鐵(tie)(tie)路、跨海(hai)大橋(qiao)、海(hai)底隧道、鐵(tie)(tie)路浮橋(qiao)、航運樞紐、港口等(deng)防災(zai)監測、安全(quan)(quan)檢測及防護(hu)系統建設。完善長途客運車(che)輛、旅(lv)游客車(che)、危險物品(pin)運輸車(che)輛和船舶生(sheng)產制造標準,提高安全(quan)(quan)性(xing)能,強(qiang)制安裝(zhuang)智能視頻監控報警、防碰撞(zhuang)和整(zheng)車(che)整(zheng)船安全(quan)(quan)運行監管技術(shu)(shu)裝(zhuang)備,對已運行的要加(jia)快安全(quan)(quan)技術(shu)(shu)裝(zhuang)備改造升級。

  (二十(shi)五)建(jian)立完(wan)(wan)善(shan)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)防(fang)(fang)治(zhi)體(ti)系。將(jiang)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)防(fang)(fang)治(zhi)納(na)入各(ge)級政府民生(sheng)工程及安全生(sheng)產工作(zuo)考核體(ti)系,制(zhi)定(ding)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)防(fang)(fang)治(zhi)中(zhong)長期規劃(hua),實(shi)施(shi)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康促(cu)進計(ji)劃(hua)。加快(kuai)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)危(wei)害(hai)嚴重企(qi)業(ye)(ye)(ye)(ye)(ye)技術改造(zao)、轉型升級和(he)淘汰(tai)退出,加強(qiang)高危(wei)粉(fen)塵、高毒物品等職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)危(wei)害(hai)源頭治(zhi)理。健(jian)全職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康監(jian)(jian)管支撐保障體(ti)系,加強(qiang)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康技術服務機構、職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)診斷(duan)鑒(jian)定(ding)機構和(he)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康體(ti)檢機構建(jian)設,強(qiang)化(hua)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)危(wei)害(hai)基礎研究、預防(fang)(fang)控制(zhi)、診斷(duan)鑒(jian)定(ding)、綜合治(zhi)療能力。完(wan)(wan)善(shan)相(xiang)關規定(ding),擴(kuo)大職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)患者救(jiu)治(zhi)范圍,將(jiang)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)失能人員納(na)入社(she)會保障范圍,對(dui)符(fu)合條件的(de)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)患者落實(shi)醫療與生(sheng)活救(jiu)助措施(shi)。加強(qiang)企(qi)業(ye)(ye)(ye)(ye)(ye)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康監(jian)(jian)管執法,督促(cu)落實(shi)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)危(wei)害(hai)告(gao)知、日(ri)常監(jian)(jian)測、定(ding)期報告(gao)、防(fang)(fang)護保障和(he)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)健(jian)康體(ti)檢等制(zhi)度措施(shi),落實(shi)職(zhi)(zhi)業(ye)(ye)(ye)(ye)(ye)病(bing)(bing)(bing)防(fang)(fang)治(zhi)主體(ti)責任。

  六、加強安全基礎保障能力建設

  (二十六)完(wan)善安(an)(an)(an)全(quan)(quan)投(tou)(tou)入(ru)長效機制(zhi)。加(jia)(jia)強(qiang)中央和地方財政安(an)(an)(an)全(quan)(quan)生產(chan)(chan)(chan)預(yu)防(fang)及應急相關資(zi)(zi)金使(shi)用管理,加(jia)(jia)大安(an)(an)(an)全(quan)(quan)生產(chan)(chan)(chan)與職業健康投(tou)(tou)入(ru),強(qiang)化審計監督。加(jia)(jia)強(qiang)安(an)(an)(an)全(quan)(quan)生產(chan)(chan)(chan)經濟(ji)政策研究,完(wan)善安(an)(an)(an)全(quan)(quan)生產(chan)(chan)(chan)專用設備(bei)企(qi)業所得(de)稅優惠(hui)目錄。落(luo)實企(qi)業安(an)(an)(an)全(quan)(quan)生產(chan)(chan)(chan)費用提取管理使(shi)用制(zhi)度,建立企(qi)業增加(jia)(jia)安(an)(an)(an)全(quan)(quan)投(tou)(tou)入(ru)的激勵約束機制(zhi)。健全(quan)(quan)投(tou)(tou)融(rong)資(zi)(zi)服務(wu)體(ti)系,引(yin)導企(qi)業集聚發展災害防(fang)治、預(yu)測預(yu)警、檢測監控、個(ge)體(ti)防(fang)護(hu)、應急處置、安(an)(an)(an)全(quan)(quan)文化等(deng)技術、裝備(bei)和服務(wu)產(chan)(chan)(chan)業。

  (二十七)建(jian)立安全(quan)(quan)(quan)(quan)科(ke)技(ji)(ji)支(zhi)撐體系。優(you)化(hua)整(zheng)合國家科(ke)技(ji)(ji)計劃(hua),統籌支(zhi)持安全(quan)(quan)(quan)(quan)生(sheng)產(chan)和(he)職業(ye)健康(kang)領域科(ke)研(yan)(yan)項(xiang)目,加(jia)強研(yan)(yan)發基地和(he)博士后科(ke)研(yan)(yan)工作站建(jian)設(she)。開(kai)展(zhan)事故預防理(li)論(lun)研(yan)(yan)究和(he)關鍵技(ji)(ji)術裝備(bei)研(yan)(yan)發,加(jia)快(kuai)成果轉化(hua)和(he)推廣(guang)(guang)應用。推動工業(ye)機器人、智(zhi)能裝備(bei)在危險(xian)工序(xu)和(he)環節廣(guang)(guang)泛應用。提升現(xian)代信(xin)(xin)息技(ji)(ji)術與安全(quan)(quan)(quan)(quan)生(sheng)產(chan)融合度(du),統一標準規(gui)范,加(jia)快(kuai)安全(quan)(quan)(quan)(quan)生(sheng)產(chan)信(xin)(xin)息化(hua)建(jian)設(she),構建(jian)安全(quan)(quan)(quan)(quan)生(sheng)產(chan)與職業(ye)健康(kang)信(xin)(xin)息化(hua)全(quan)(quan)(quan)(quan)國“一張(zhang)網”。加(jia)強安全(quan)(quan)(quan)(quan)生(sheng)產(chan)理(li)論(lun)和(he)政策研(yan)(yan)究,運用大數(shu)據(ju)技(ji)(ji)術開(kai)展(zhan)安全(quan)(quan)(quan)(quan)生(sheng)產(chan)規(gui)律(lv)性、關聯性特征分(fen)析,提高安全(quan)(quan)(quan)(quan)生(sheng)產(chan)決策科(ke)學化(hua)水平。

  (二十九)發揮市場機制(zhi)推(tui)動作(zuo)用(yong)。取消安(an)(an)全生(sheng)產(chan)(chan)風險(xian)抵押金制(zhi)度(du),建(jian)立健(jian)全安(an)(an)全生(sheng)產(chan)(chan)責任保險(xian)制(zhi)度(du),在(zai)礦山(shan)、危險(xian)化學品、煙花(hua)爆竹、交(jiao)通運輸(shu)、建(jian)筑施(shi)工(gong)、民用(yong)爆炸物品、金屬(shu)冶(ye)煉、漁(yu)業生(sheng)產(chan)(chan)等高危行(xing)業領域強制(zhi)實(shi)施(shi),切實(shi)發揮保險(xian)機構參與(yu)風險(xian)評估管控和事故(gu)預防功能。完善(shan)工(gong)傷(shang)保險(xian)制(zhi)度(du),加快制(zhi)定工(gong)傷(shang)預防費(fei)用(yong)的(de)提取比例、使用(yong)和管理(li)具體辦(ban)法。積極推(tui)進安(an)(an)全生(sheng)產(chan)(chan)誠信體系建(jian)設,完善(shan)企(qi)業安(an)(an)全生(sheng)產(chan)(chan)不(bu)良記錄“黑名單”制(zhi)度(du),建(jian)立失信懲戒和守信激勵機制(zhi)。

  (三十)健(jian)全(quan)安全(quan)宣傳教(jiao)育(yu)(yu)體(ti)系(xi)(xi)。將安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)監(jian)督(du)管理納(na)入(ru)各(ge)級黨政領導干部培訓內容。把安全(quan)知(zhi)識(shi)(shi)普及納(na)入(ru)國民(min)教(jiao)育(yu)(yu),建立(li)完(wan)善中小學安全(quan)教(jiao)育(yu)(yu)和(he)高危(wei)行業(ye)職(zhi)業(ye)安全(quan)教(jiao)育(yu)(yu)體(ti)系(xi)(xi)。把安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)納(na)入(ru)農(nong)民(min)工技能培訓內容。嚴(yan)格落實企業(ye)安全(quan)教(jiao)育(yu)(yu)培訓制度,切實做到先培訓、后(hou)上崗。推進(jin)安全(quan)文化(hua)建設,加強(qiang)(qiang)警示教(jiao)育(yu)(yu),強(qiang)(qiang)化(hua)全(quan)民(min)安全(quan)意識(shi)(shi)和(he)法治意識(shi)(shi)。發揮(hui)工會、共(gong)青團、婦聯等(deng)群團組織(zhi)作用,依(yi)法維護職(zhi)工群眾(zhong)的知(zhi)情權、參與(yu)(yu)權與(yu)(yu)監(jian)督(du)權。加強(qiang)(qiang)安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)公益宣傳和(he)輿(yu)論監(jian)督(du)。建立(li)安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)“12350”專線與(yu)(yu)社會公共(gong)管理平(ping)臺統一接報、分類處置(zhi)的舉(ju)報投訴機制。鼓勵開(kai)展安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)志愿服(fu)務和(he)慈善事業(ye)。加強(qiang)(qiang)安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)國際交流合作,學習借鑒國外安全(quan)生(sheng)(sheng)(sheng)產(chan)(chan)(chan)與(yu)(yu)職(zhi)業(ye)健(jian)康先進(jin)經驗。

  各地區各部門要(yao)(yao)加強組(zu)織領(ling)導(dao),嚴格實(shi)行領(ling)導(dao)干部安全(quan)(quan)生(sheng)(sheng)產工(gong)作責(ze)任(ren)(ren)制,根(gen)據(ju)本(ben)意見提出的(de)任(ren)(ren)務(wu)和(he)要(yao)(yao)求,結合實(shi)際認真研(yan)究制定(ding)實(shi)施辦(ban)(ban)法(fa),抓緊出臺推(tui)進安全(quan)(quan)生(sheng)(sheng)產領(ling)域改革發展的(de)具體政策措施,明(ming)確責(ze)任(ren)(ren)分工(gong)和(he)時(shi)間進度(du)要(yao)(yao)求,確保各項改革舉措和(he)工(gong)作要(yao)(yao)求落實(shi)到位。貫(guan)徹落實(shi)情況要(yao)(yao)及時(shi)向黨(dang)中央、國(guo)務(wu)院報告,同時(shi)抄送(song)國(guo)務(wu)院安全(quan)(quan)生(sheng)(sheng)產委員會辦(ban)(ban)公室。中央全(quan)(quan)面深化(hua)改革領(ling)導(dao)小組(zu)辦(ban)(ban)公室將適(shi)時(shi)牽(qian)頭組(zu)織開展專項監督檢查。
